Terms of Use for TestMax

1. Acceptance of Terms

Welcome to TestMax! These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and TestMax ("we," "us," or "our") regarding your access to and use of the TestMax mobile application (the "App") and related services (collectively, the "Services").

By creating an account, downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the App.

2. Eligibility

2.1. Age Requirement

You must be at least 16 years of age to use TestMax. By using the App, you represent and warrant that you meet the minimum age requirement.

2.2. Parental Consent (Ages 16-17)

If you are between 16 and 17 years of age (a "Minor"), you must have your parent or legal guardian review and agree to these Terms on your behalf before using the App. By using the App as a Minor, you represent that your parent or legal guardian has consented to your use of the Services.

Parents/Guardians: If your child is using TestMax, you are responsible for:

• Supervising their use of the App

• Understanding what data is collected (see our Privacy Policy)

• Ensuring they use the App appropriately and safely

• Monitoring any health or fitness activities they undertake through the App

2.3. Account Accuracy

You represent that all information you provide during registration and use of the App is accurate, current, and complete. You agree to update your information as necessary to maintain its accuracy.

2.4. Special Notice for Minors

If you are under 18, please be aware that:

• The App's health metrics and recommendations are designed for adults and may not be appropriate for developing bodies

• Testosterone levels naturally vary during adolescence and puberty

• You should always consult with a parent/guardian and healthcare provider before starting any fitness or wellness program

• The AI Coach may provide general advice not specifically tailored to minors

• Your parent or guardian should supervise your use of exercises and health recommendations

3. Description of Services

TestMax is a wellness and lifestyle optimization app designed to help users:

• Facial Analysis: Upload photos for AI-powered analysis to estimate testosterone levels, biological age, and facial features

• AI Coach: Receive personalized advice and answers to questions about testosterone and wellness

• Exercise Programs: Access guided exercises including deep squats, sprints, planks, glute bridges, and Kegel exercises

• Daily Habit Tracking: Track daily routines and maintain activity streaks

• Progress Monitoring: View historical scans and track improvements over time

• Personalized Recommendations: Receive customized health and wellness suggestions

3.1. Service Availability

We strive to provide continuous access to the Services, but we do not guarantee that the App will be available at all times or free from interruptions, delays, or errors. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

4. User Accounts

4.1. Account Creation

To use TestMax, you must create an account using:

• Apple Sign-In, or

• Google Sign-In

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2. Account Security

You agree to:

• Provide accurate and truthful information during registration

• Maintain the security of your account credentials

• Notify us immediately of any unauthorized access or security breach

• Not share your account with others

• Not create multiple accounts for the same individual

4.3. Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited activities.

5. Subscription and Payment Terms

5.1. Subscription Plans

TestMax offers subscription-based premium features. Subscription details, including pricing and billing cycles, are displayed in the App.

5.2. Payment

• Payments are processed through your Apple App Store or Google Play Store account

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• You can manage or cancel your subscription through your App Store or Google Play Store account settings

5.3. Free Trials

We may offer free trial periods for new subscribers. If you do not cancel before the trial period ends, you will be automatically charged for a subscription.

5.4. Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated to you in advance, and your continued use after the price change constitutes acceptance of the new price.

5.5. Refunds

Refund policies are governed by the Apple App Store or Google Play Store terms. Generally, all subscription fees are non-refundable except as required by law or at our sole discretion.

5.6. Access Termination Upon Non-Payment

If your subscription expires or payment fails, you may lose access to premium features. Your data will be retained according to our Privacy Policy, but certain features may become unavailable until you resubscribe.

6. User Responsibilities and Conduct

6.1. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights

• Upload or transmit viruses, malware, or any malicious code

• Attempt to gain unauthorized access to the App or its systems

• Reverse engineer, decompile, or disassemble the App

• Use automated systems (bots, scrapers) to access the App

• Impersonate any person or entity

• Harass, abuse, or harm other users

• Upload inappropriate, offensive, or illegal content

• Use the App for any commercial purpose without our permission

• Share, sell, or redistribute content from the App without authorization

• Manipulate or falsify your scan results or progress data

• Use the App in any way that could damage, disable, or impair our services

6.2. Content You Provide

You retain ownership of content you upload (such as facial photos), but you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely for the purpose of providing and improving the Services.

You represent and warrant that:

• You own or have the necessary rights to upload your content

• Your content does not violate any laws or third-party rights

• Your content does not contain confidential information you're not authorized to share

7. Intellectual Property Rights

7.1. Our Ownership

The App and all its content, features, and functionality (including but not limited to software, algorithms, text, graphics, logos, icons, images, audio, video, and design) are owned by TestMax and are protected by international copyright, trademark, patent, and other intellectual property laws.

7.2. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include:

• Any right to reproduce, modify, distribute, or create derivative works

• Any right to reverse engineer or access source code

• Any right to use our trademarks or branding

• Any rights not expressly granted in these Terms

7.3. Trademarks

TestMax, the TestMax logo, and other marks are trademarks of TestMax. You may not use these trademarks without our prior written consent.

8. Health and Medical Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY

8.1. Not Medical Advice

TestMax is a wellness and lifestyle app and is NOT a medical device or service. The App provides:

• Estimated metrics based on facial analysis algorithms

• General wellness information and suggestions

• Motivational content and habit tracking tools

The App does NOT provide:

• Medical diagnosis, treatment, or advice

• Professional healthcare services

• FDA-approved or clinically validated medical assessments

• Replacement for consultations with qualified healthcare providers

8.2. No Doctor-Patient Relationship

Use of the App does not create a doctor-patient or healthcare provider-patient relationship between you and TestMax or any associated parties.

8.3. Accuracy Limitations

Testosterone estimates, biological age calculations, health scores, and other metrics provided by the App are approximations based on facial analysis algorithms and should NOT be considered accurate medical measurements. These estimates:

• Are for informational and motivational purposes only

• May not reflect your actual health status

• Should not be used for medical decision-making

• Are not validated by clinical studies

• May vary significantly from actual laboratory test results

8.4. AI Coach Limitations

Our AI Coach:

• Provides general wellness information and suggestions

• Is powered by artificial intelligence and may produce inaccurate or inappropriate responses

• Does not replace professional medical, psychological, or nutritional advice

• Should not be used for medical emergencies or urgent health concerns

8.5. Medical Consultation Required

You should always consult with qualified healthcare professionals before:

• Making any health-related decisions

• Starting any new exercise program

• Taking any supplements or medications

• Interpreting or acting on information from the App

• Using the App's recommendations if you have any medical conditions

Additional Requirements for Minors (Under 18):

If you are under 18 years of age, you MUST:

• Have parental/guardian approval before using any exercise programs

• Consult with a pediatrician or family doctor before starting fitness routines

• Have parental supervision when performing exercises

• Understand that testosterone levels and physical development vary greatly during adolescence

• Not use the App's metrics to make health decisions without adult guidance

8.6. Emergency Situations

If you are experiencing a medical emergency, call emergency services immediately. Do not rely on the App for emergency medical assistance.

8.7. No Guarantees

We make no guarantees, representations, or warranties regarding:

• The accuracy of testosterone estimates or health metrics

• Health improvements or outcomes from using the App

• The effectiveness of recommended exercises or habits

• Results from following App suggestions

8.8. Assumption of Risk

By using TestMax, you acknowledge and accept the risks associated with self-directed wellness programs, including but not limited to the risk of injury from exercises, disappointment from unmet expectations, or reliance on estimated rather than measured health metrics.

9. Third-Party Services and Content

9.1. Third-Party Integrations

The App uses third-party services including:

• Anthropic (Claude AI) for AI coaching

• Supabase for data storage

• Mixpanel for analytics

• Superwall for subscription management

• Apple/Google for authentication

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their content.

9.2. Third-Party Links

The App may contain links to third-party websites or resources. We do not endorse and are not responsible for the content, products, or services offered by third parties.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

10.1. No Consequential Damages

TestMax, its affiliates, officers, directors, employees, agents, and licensors SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data

• Loss of business opportunities

• Personal injury or property damage

• Health complications or medical issues

• Emotional distress or mental anguish

• Costs of substitute services

Even if we have been advised of the possibility of such damages.

10.2. Maximum Liability Cap

Our total liability to you for any claims arising from your use of the App shall not exceed the greater of:

• The amount you paid us in the 12 months prior to the event giving rise to liability, or

• $100 USD

Basis of the Bargain

You acknowledge that we have set our prices and entered into these Terms in reliance upon the limitations of liability set forth herein, which allocate the risk between us and form the basis of our agreement.

10.4. Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless TestMax, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App

• Your violation of these Terms

• Your violation of any rights of third parties

• Your violation of any applicable laws or regulations

• Content you upload or transmit through the App

• Any health issues arising from your use of the App or reliance on its recommendations

• Any false or misleading information you provide

Parents/Guardians: If you have authorized a minor to use the App, you agree to indemnify and hold TestMax harmless from any claims arising from your child's use of the App, including but not limited to injuries, health issues, or violations of these Terms.

12. Exercise Warnings and Disclaimers

12.1. Physical Activity Risks

The App provides exercise programs and routines. Physical exercise involves inherent risks of injury. Before starting any exercise program:

• Consult with a healthcare provider, especially if you:

  • Have any pre-existing medical conditions

  • Are pregnant or nursing

  • Have cardiovascular, respiratory, or orthopedic issues

  • Are taking medications that may affect your ability to exercise

  • Have any concerns about your ability to exercise safely

12.2. Your Responsibility

You are solely responsible for:

• Determining whether exercises are appropriate for your fitness level

• Performing exercises with proper form and technique

• Listening to your body and stopping if you experience pain or discomfort

• Using appropriate equipment and ensuring a safe environment

• Gradually progressing in intensity and duration

12.3. Additional Responsibilities for Parents/Guardians of Minors

If your child (under 18) is using the App, you are responsible for:

• Supervising their exercise activities

• Ensuring exercises are age-appropriate and safe

• Monitoring for signs of overexertion or injury

• Consulting with a pediatrician about appropriate fitness activities

• Adjusting recommendations to suit your child's developmental stage

12.4. Release of Liability

You assume all risks associated with exercising based on App recommendations, and you release TestMax from any liability for injuries, damages, or health issues that may result.

13. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to:

• Collection and processing of your data as described in the Privacy Policy

• Use of cookies and tracking technologies for analytics

• Sharing of data with third-party service providers as necessary to operate the Services

• International transfer of data to countries where our service providers operate

14. Modification of Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this document

• Notify you through the App or via email (for material changes)

• Provide you with the opportunity to review the updated Terms

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

15. Modification or Termination of Services

15.1. Our Right to Modify

We reserve the right to:

• Modify, suspend, or discontinue any feature or aspect of the App

• Change pricing, subscription plans, or service offerings

• Update algorithms, analyses, or recommendations

• Remove or restrict access to certain features

15.2. Termination by You

You may terminate your use of the App at any time by:

• Deleting your account through the App settings

• Uninstalling the App from your device

• Cancelling your subscription through your App Store account

15.3. Termination by Us

We may suspend or terminate your account and access to the Services immediately, without notice, if you:

• Violate these Terms

• Engage in fraudulent or illegal activities

• Abuse or harass other users or our staff

• Attempt to compromise the security of the App

• Use the App in a manner that harms our business or reputation

15.4. Effect of Termination

Upon termination:

• Your right to use the App immediately ceases

• Your data may be deleted according to our Privacy Policy

• Certain provisions of these Terms survive termination (including limitations of liability, indemnification, and dispute resolution)

• No refunds will be provided for unused subscription periods except as required by law

16. Dispute Resolution

16.1. Informal Resolution

Before filing any formal claim, you agree to contact us and attempt to resolve the dispute informally. Please send detailed information about your dispute to support@testmaxai.app.

16.2. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

16.3. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You and TestMax agree to waive the right to a jury trial or to participate in a class action.

16.4. Exceptions to Arbitration

Either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

16.5. Small Claims Court

You may alternatively bring an individual action in small claims court if your claim qualifies.

17. Miscellaneous Provisions

17.1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TestMax regarding the Services and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to reflect the parties' intent as closely as possible.

17.3. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

17.4. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms to any affiliate or successor without restriction.

17.5. No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

17.6. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

17.7. Electronic Communications

You consent to receive electronic communications from us, including emails, push notifications, and in-app messages. These communications may include notices about your account, transactional information, and marketing messages (which you can opt out of).

17.8. Language

These Terms are prepared in English. If these Terms are translated into another language, the English version shall prevail in case of any inconsistency.

18. California Users - Additional Rights

If you are a California resident, you have certain rights under California law, including:

19. Export Control

The App may be subject to export control laws and regulations. You agree not to export, re-export, or transfer the App in violation of applicable export laws and regulations.

20. Government Users

If you are a government entity or using the App on behalf of a government entity, the App is provided as "Commercial Computer Software" and "Commercial Computer Software Documentation" as defined in applicable regulations, and your rights are limited to those expressly granted in these Terms.

21. Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas about the App ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our Services without any obligation to compensate you.

You specifically acknowledge and agree that:

• You are 16 years of age or older

• If you are under 18, your parent or guardian has consented to your use of the App

• You understand that TestMax is not a medical service

• You will not rely on the App for medical advice or decisions

• You accept the risks associated with using the App
